“In early May, Michigan’s Democratic Attorney General Dana Nessel joined counterparts in 14 other states to challenge President Trump’s declaration of a “national energy emergency” to justify fast tracking fossil fuel projects. The lawsuit names Trump and the U.S. Army Corps of Engineers as defendants, among others.

The proposed Line 5 oil pipeline tunnel under the Straits of Mackinac is one of many energy projects currently proposed nationwide. Six Michigan Indigenous tribes formally withdrew cooperation with the review in objection to the fast-track plans.

State AGs recognize the importance of reliable energy production. However, the President’s assertion of an “energy emergency” is contradicted by record U.S. oil and gas production, the states’ lawsuit claims.

“True emergencies are disasters that directly impact residents, not fake crises to pad Big Oil’s profits,” Nessel said.
